Terms & Conditions of Purchase of a SimpleSite Subscription or Service
Please read the following terms and conditions of purchase of SimpleSite subscriptions and website services carefully before using a SimpleSite website or buying SimpleSite subscriptions. By using SimpleSite’s website service and by agreeing to purchase a subscription for our website services, you declare that you have read, understood and accepted these terms and conditions. If you do not agree with these terms and conditions please do not use the SimpleSite online products and website services.
(If you are already a SimpleSite user and contact us, we request you include your SimpleSite website address in your email, and email us from the email address you used to make your SimpleSite.)
All payment relates directly to the SimpleSite PRO or SimpleSite E-commerce subscription and all additional purchases and product features that fall under this subscription. A description of the subscription being purchased, the price of the subscription and the duration of the subscription is stated at the time of purchase.
Your SimpleSite PRO or SimpleSite E-commerce subscription is set to renew automatically at the regular subscription price to ensure that your website’s online presence is uninterrupted and does not expire. This means that you will automatically be charged 10 days before the expiration date of the PRO or E-commerce subscription period.
You can cancel the automatic renewal service at any time by clicking on the “Your Subscription” menu tab, when you are logged in to SimpleSite. The latest date to cancel the automatic renewal and avoid future charges is 10 days before the expiration date of your PRO or E-commerce subscription.
Only valid SimpleSite PRO subscribers can have a domain name for a SimpleSite website.
If we are unable to automatically renew your subscription we will inform you by email 10 days before your PRO or E-commerce subscription expires. You will then be asked to login to SimpleSite and make the payment for the next subscription period.
You can review previous payments and print receipts by clicking “Your Subscription” when you are logged in to SimpleSite.
As a SimpleSite customer you are at all times granted access to the free SimpleSite Basic platform. SimpleSite customers can gain access to the SimpleSite PRO and/or E-commerce platform when SimpleSite has registered a subscription payment. When a payment is made using online payment systems e.g. a credit card, you will have immediate access as soon as your payment has been verified. Other payment types may take some days to process before access is granted.
SimpleSite PRO and E-commerce subscribers have a 14 day right of cancellation after the subscription has been purchased. If you use the service or product during this 14 day period, then your right of cancellation period is invalidated.
SimpleSite E-commerce customers can also choose to downgrade to a SimpleSite PRO subscription within the 14 days cancellation period. However it isn’t possible to downgrade from a SimpleSite PRO subscription to the free SimpleSite Basic platform.
A compensation claim cannot exceed the original PRO or E-commerce subscription price. Please note that the online product purchased is only for use by the customer and may not be shared or lent out by password sharing, transferred, resold or in any other way redistributed.
SimpleSite reserves the right to suspend and/or terminate any purchase of online products if SimpleSite discovers that third parties are using promotional offers for unauthorized financial gain or commission.
Downtime means periods of unavailability or limited availability of the SimpleSite online service. SimpleSite does not guarantee availability of the service and cannot be held responsible for any downtime or difficulties in accessing the service, which can occur occasionally for updates and maintenance. Furthermore SimpleSite is not responsible for any downtime caused by third party providers, Internet providers etc. or for downtime caused by Force Majeure.
SimpleSite reserves the right to change these Terms and Conditions. SimpleSite reserves the right to change subscription prices at a minimum of fifteen (15) days notice. We reserve the right to require you to change your login details whether for security or any other reason.
If you are not satisfied with a decision made by our customer service, please resend your complaint and include the answer from customer service and the reason why you disagree with their decision. Please send your complaint to complaint@SimpleSite.com.
To best assist you, we kindly ask that you send your complaint from the same email address as you used to contact customer service. Please note that only cases that have already been answered by our customer service will be accepted by our complaints department. All other inquiries will be forwarded to our customer service at customerservice@SimpleSite.com. Please allow up to 3 working days for a reply from the complaints department.
If you are a EU citizen and do not feel that our service met with your expectations, you can also complain to the EU's Online Dispute Resolution - http://ec.europa.eu/consumers/odr/
Conditions for using the SimpleSite product
You hereby agree that you will only use the service strictly in accordance with this Agreement, and specifically that you will provide accurate and complete information in connection with establishing your SimpleSite website.
PLEASE NOTE: Your SimpleSite product is provided under the absolute condition that it may not be used to publish or support offensive content of any kind. This includes unsolicited commercial emailing, bulk emailing, defamatory speech, distribution of Internet viruses, worms, Trojan horses and other destructive activities, pornography, adult content, stalking or abusive postings. You will not violate any laws in using the service. All content that SimpleSite deems offensive will be deleted immediately and without notice regardless of the subscription status of your SimpleSite product or service. SimpleSite will not issue any refund for a SimpleSite website that has been terminated for a violation of the above terms.
You agree that you will not use your SimpleSite product to solicit passwords or other personal information from third parties for any unlawful or fraudulent purpose. You agree that you will not falsely impersonate any person or entity or misleadingly represent your relationship to any person or entity. You agree that you will not present or send “spam”.
You agree that you are solely responsible for all content (data, text, software, music, sounds, images, photographs, graphics, video, messages, files or any other type of content) that you post on your SimpleSite website and that you are responsible for ensuring that your content does not infringe local or International copyright laws in any way. SimpleSite does not monitor or review content and is not liable in any way for the quality or nature of the content you have posted. SimpleSite is not responsible for any content you have posted on your SimpleSite website and cannot be held liable for any claim by you or any third party content owners.
If your content does not breach the terms and conditions, you are free to publish links to your SimpleSite website wherever you choose and there are no publication restrictions on your SimpleSite website. You are not permitted to use your SimpleSite website to display photos that are published on third party websites.
SimpleSite cannot be held liable by you or any third party for loss or misuse of content, or for direct or indirect financial loss in connection with any content misuse of whatever nature.
SimpleSite cannot be held liable for misuse of your password, whether caused by your negligence, or by the password or SimpleSite being hacked.
SimpleSite reserves the right to grant the police or a court of law access to the content you have posted on your SimpleSite website. In the event that SimpleSite believes that a SimpleSite website contains illegal content (e.g. child pornography etc.) or facilitates or takes part in illegal activities, SimpleSite reserves the right to suspend or terminate your SimpleSite website without prior notice and inform the police of the illegal content/activity and your identity.
SimpleSite reserves the right to terminate or suspend access to our services and/or block your website without prior notice.
SimpleSite reserves the right to delete an inactive SimpleSite and all posted content 3 months after a subscription expires. This means that a SimpleSite website owner has a 3 months period after the expiration date of the subscription to renew the subscription.
SimpleSite cannot be held directly or indirectly responsible for any loss of any kind in connection with terminating and deleting SimpleSite websites. SimpleSite cannot be held responsible for any loss of any kind in the event that the SimpleSite service is partly or wholly unavailable.
By registering to SimpleSite and providing your email address, you expressly agree to receive promotional content from SimpleSite, by email, from time to time. If you wish not to receive such promotional content / notices, you may notify SimpleSite at any time or unsubscribe directly in our emails. Note that there are certain communications from us, you cannot unsubscribe, Including notices of transactions on your account.
If you have established your free SimpleSite subscription via a third party, e.g. in connection with a magazine or club subscription, the above terms and conditions regarding expiry and payment might not be valid. Please check the terms and conditions of the third party trial subscription.
